SarthiAI Terms of Service

The agreement between you and Sarth AI Tech LLP covering the SarthiAI apps, sarthiai.co.in and related services.

These Terms of Service (“Terms”) govern your access to and use of SarthiAI’s mobile applications, websites, and related services (collectively, the “Services”). By creating an account, accessing, or using the Services, you agree to be bound by:

  • these Terms,
  • the SarthiAI Privacy Policy, and
  • the SarthiAI Cookie Policy (for website use).

If you do not agree, you must not use the Services.

1Parties, Scope, and Related Documents

1.1SarthiAI entity: These Terms are between you and Sarth AI Tech LLP, having its registered office at 1010 United Athashri, DN Parande Park Marg, Dhanori, Pune, Maharashtra 411047 (“SarthiAI”, “we”, “us”, “our”).

1.2Who these Terms apply to:

These Terms apply to:

  • Individual learners (school students, college students, self‑learners, and working professionals).
  • Educators, faculty, tutors, and school/college staff using SarthiAI in a professional capacity.
  • Schools, colleges, coaching centres, and other educational institutions that onboard learners to SarthiAI (“Institutions”).

1.3Service channels covered:

These Terms apply to:

  • the SarthiAI mobile app(s);
  • any SarthiAI website or web interface exposing account or learning features;
  • any browser-based tools or integrations that SarthiAI may offer.

1.4Privacy and Cookie Policies:

  • The Privacy Policy explains how SarthiAI collects, uses, stores, shares, and deletes personal data, including children’s data, and how account deletion and retention work.
  • The Cookie Policy explains how SarthiAI’s website uses cookies and similar technologies.
  • Both are incorporated into and form part of these Terms.

1.5Institution agreements: If SarthiAI signs a separate written agreement (for example, a Master Services Agreement, letter of engagement, or data processing addendum) with an Institution, that agreement will prevail over these Terms for that Institution and its authorized users to the extent of any conflict.

2Eligibility, Children, and User Categories

2.1Definitions:

  • “Child” or “minor” means an individual under 18 years of age, in line with the Digital Personal Data Protection Act, 2023 (“DPDP Act”).
  • “Adult” means an individual who is 18 years or older and legally competent to contract.
  • “Institution User” means an educator, staff member, administrator, or learner using the Services under an Institution’s onboarding.

2.2Individual accounts (18+): To create an account directly in your own name (not via a school/college arrangement), you must be at least 18 years old and legally competent to contract under Indian law.

2.3Child users via Institutions: Where a Child uses SarthiAI through an Institution:

  • the Institution is responsible for verifying the child’s enrolment and basic age/identity details using its own records;
  • SarthiAI may rely on the Institution’s verification process for such school‑managed enrolments, subject to applicable law and SarthiAI’s internal onboarding controls;
  • additional protections for children’s personal data apply, as described in the Privacy Policy (for example, restrictions on behavioural tracking and targeted advertising towards children).

2.4Child users via parent/guardian:

Where a Child is not using SarthiAI through an Institution:

  • registration must be completed by the child’s parent or lawful guardian on the child’s behalf;
  • the parent/guardian represents that they have lawful authority to create and manage the account;
  • the parent/guardian is responsible for supervising the child’s use and ensuring compliance with these Terms and the Privacy Policy.

2.5Self‑declared information: You agree that all information you provide during registration and use (including date of birth, contact details, and learner persona) is true, accurate, and complete. SarthiAI may rely on this information (for example, to determine whether you are a Child or an Adult and apply age‑related protections), subject to applicable law.

2.6Institution administrators:

Institutions may assign administrators who can:

  • create and manage accounts under the Institution’s umbrella;
  • access certain usage metrics and content associated with Institution-linked accounts, as described in the Privacy Policy and relevant institutional agreements;
  • request modifications or deletion of students’ accounts and associated data, subject to law and the Privacy Policy.

3Account Registration and Security

3.1Registration: Some parts of the Services require an account. When registering, you must provide accurate information (for example, name, email, date of birth, and learner persona).

3.2Third‑party login: If you log in via Google, Apple, or another single sign‑on provider:

  • you authorize SarthiAI to receive limited profile information from that provider (e.g., name, email, provider ID), as permitted by their terms and your settings;
  • your relationship with that provider is governed solely by its own terms and privacy policy.

3.3Account security:

You are responsible for:

  • keeping your username and password confidential;
  • not sharing your account or credentials with others;
  • promptly notifying SarthiAI of any unauthorized access or suspected compromise.

Except where SarthiAI has failed to implement reasonable security safeguards, you are responsible for all activities occurring under your account.

3.4Suspension for security reasons: SarthiAI may temporarily suspend or restrict access to an account if it reasonably suspects:

  • unusual or suspicious login behaviour;
  • compromised credentials;
  • activity that may violate these Terms or applicable law.

4Description of the Services and Licence

4.1Services description:

SarthiAI is an educational assistant that uses artificial intelligence to:

  • answer questions and provide explanations;
  • transform content you provide into summaries, flashcards, quizzes, and lesson paths;
  • personalize learning support based on your learner persona and in‑app behaviour;
  • support institutional teaching workflows for educators and Institutions.

4.2Licence to individual and Institution users:

Subject to these Terms, SarthiAI grants you a limited, revocable, non‑exclusive, non‑transferable licence to:

  • install and use the SarthiAI app on a device you control;
  • access and use the Services for your personal learning or professional educational use, as applicable.

4.3No resale or unauthorized commercial use:

Except where expressly permitted in a written agreement with SarthiAI, you may not:

  • resell, rent, or sublicense the Services;
  • use the Services to provide AI services to third parties as your own offering;
  • bundle the Services into any commercial product or platform.

4.4Service changes: SarthiAI may add, modify, or discontinue features to improve performance, security, or compliance, or due to technical or business reasons. Where changes materially impact the Service, SarthiAI will use reasonable efforts to notify users via the app, website, or email.

4.5Third-Party Authentication: Where a User chooses to authenticate through a third-party identity provider (including Google, Apple or any other authorised authentication provider), SarthiAI shall receive only such profile information as the User authorises the provider to share during the authentication process, including the User's name, email address and provider identifier where applicable. The User's relationship with such third-party provider shall continue to be governed by that provider's applicable terms and privacy policy.

5AI Tools, Outputs, and Limitations

5.1Use of AI infrastructure (Cloudflare Workers AI): SarthiAI uses third‑party AI infrastructure, including Cloudflare Workers AI and similar platforms, to process prompts, conversation transcripts, and uploaded content in order to generate AI‑based outputs (“AI Output”). Depending on service configuration and available compute resources, such processing may occur outside India, as described in the Privacy Policy.

5.2Nature of AI Output

AI Output is:

  • generated automatically from your inputs and other technical signals;
  • not guaranteed to be accurate, complete, unbiased, or up to date;
  • intended as an educational aid, not a substitute for independent learning or professional advice.

5.3AI Infrastructure: SarthiAI uses third-party artificial intelligence infrastructure and cloud-based AI processing services for processing User Content and generating AI Output. Depending upon the functionality used, User prompts, uploaded content, conversation history and related inputs may be processed through such infrastructure solely for providing the requested Services. Further details regarding such processing are available in the Privacy Policy.

5.4Personalised Learning Experience. Certain features of the Services may be personalised based on information voluntarily provided by the User, including educational level, selected subjects, preferred language, learning goals, previous interactions and other learning preferences. Such personalisation is intended solely to improve the User's learning experience and shall be governed by the Privacy Policy.

5.5No professional advice: AI Output and other content provided via the Services do not constitute legal, medical, financial, or other professional advice. You must not rely on them as such.

5.6Your responsibility for AI Output:

You are solely responsible for:

  • reviewing and validating AI Output before relying on it;
  • ensuring any use of AI Output complies with examination rules, academic integrity policies, employment contracts, and applicable law;
  • ensuring that AI Output used with or for children is appropriate and safe for the intended age group.

5.7Model and feature availability: SarthiAI does not warrant continuous availability of any particular AI model, feature, or configuration. SarthiAI may change AI models or providers over time without prior notice, while keeping disclosures in the Privacy Policy updated.

6User Content and Rights

6.1User Content definition:

“User Content” includes:

  • prompts, questions, and chat messages submitted by you;
  • files you upload (for example, PDFs, DOCX, TXT, MD, CSV, and certain audio files);
  • notes, tags, or derived content you create within the Services.

6.2Ownership of User Content: As between you and SarthiAI, you retain ownership of your User Content, subject to the licences granted in this section.

6.3Licence to SarthiAI:

You grant SarthiAI a non‑exclusive, worldwide, royalty‑free licence to:

  • host, store, and process your User Content to provide and maintain the Services;
  • use your User Content to generate AI Output and other service functionalities you request;
  • use your User Content to support security, troubleshooting, and service improvement, in line with the Privacy Policy;
  • use your User Content as required to comply with legal obligations and enforce these Terms.

6.4Institution access to User Content:

If you use SarthiAI under an Institution’s domain or licence:

  • authorized administrators of that Institution may access certain User Content and usage data associated with institutional accounts, as described in the Privacy Policy and any institutional agreement;
  • Institution administrators may manage, restrict, or terminate institutional access, including access to User Content generated under institutional accounts.

6.5No obligation to store all content: SarthiAI is not required to store all User Content indefinitely. Storage and retention of personal data and certain records (including logs) are governed by the Privacy Policy and applicable law.

6.6Monitoring and removal:

SarthiAI does not pre‑screen all User Content but may monitor usage and content where necessary for:

  • security and abuse detection;
  • compliance with law, institutional policies, or these Terms;
  • responding to lawful requests from courts or authorities.

SarthiAI may remove or restrict access to User Content that appears unlawful, harmful, or in violation of these Terms.

7Acceptable Use and Prohibited Activities

You must use the Services in a lawful, responsible manner. You agree not to:

7.1Illegal or harmful content:

  • upload, generate, or share content that is illegal, defamatory, obscene, hateful, threatening, or otherwise harmful;
  • promote violence, self‑harm, exploitation, or abuse.

7.2Categories of User Content: User Content includes prompts, questions, chat messages, uploaded documents, images, audio recordings, notes, learning preferences, learning history, feedback and any other content or material submitted by a User through the Services.

7.3Children’s personal data outside approved flows:

input or upload children’s personal data (for example, full names, contact details, identification numbers) into generic or experimental tools, unless you are using a flow explicitly designated for school use or parent/guardian-managed accounts in line with the Privacy Policy and any institutional agreement.

7.4Academic or assessment misconduct

  • use the Services to cheat in examinations, assignments, or assessments;
  • misrepresent AI Output as your own unaided work in violation of academic or exam rules.

7.5Security and technical abuse

  • attempt to gain unauthorized access to accounts, systems, or networks;
  • interfere with or disrupt the Services, including by introducing malware or excessive traffic;
  • bypass or attempt to bypass security measures, rate limits, or access controls.

7.6Misuse of intellectual property:

  • use the Services to infringe third‑party intellectual property rights;
  • attempt to extract or replicate proprietary models or data beyond what is permitted by these Terms and applicable law.

7.7Reverse engineering:

decompile, reverse engineer, or attempt to derive the source code or underlying models of the Services, except to the extent such restriction is not permitted by law.

SarthiAI may suspend or terminate accounts that engage in prohibited activities, in addition to any other remedies available under law.

8Payments and Subscriptions (If and When Applicable)

8.1Free access: SarthiAI may provide a free tier for individual users or for trial purposes. Features and availability may change over time.

8.2Paid plans:

If SarthiAI offers paid subscription plans (“Paid Plans”):

  • the plan details, duration, and pricing will be displayed in the app or on the SarthiAI website;
  • you authorize SarthiAI and its payment gateway(s) to charge your selected payment method for the applicable fees.

8.3Website payment gateway:

If you pay through SarthiAI’s website:

  • the payment will be processed by a third‑party payment gateway;
  • you may be required to accept that gateway’s terms and privacy policy;
  • SarthiAI will only receive limited transaction information, as described in the Privacy Policy.

8.4App store billing:

If you subscribe through an app store (e.g., Google Play, Apple App Store):

  • billing and cancellation may be governed by that store’s terms;
  • any differential pricing between in‑app purchases and website payments will be displayed to you before purchase.

8.5Renewals and cancellations:

Unless otherwise stated:

  • Paid Plans renew automatically for the same term at the then‑current price;
  • you may cancel future renewals via the in‑app or website subscription settings, or via the relevant app store, as applicable.

8.6Refunds: Refund rights, if any, will be disclosed at the time of purchase or in a separate refund policy. Except where required by law, fees are typically non‑refundable once a billing cycle starts.

8.7Taxes: Fees may be subject to GST or other applicable taxes. You are responsible for paying any such taxes unless SarthiAI collects them at checkout.

9Third‑Party Services and Website Cookies

9.1Third‑party services:

The Services may integrate or interact with:

  • authentication providers (Google, Apple, etc.);
  • payment gateways;
  • Cloudflare Workers AI and other AI infrastructure providers;
  • analytics or support tools on the website.

Your use of these services is subject to their own terms and privacy policies.

9.2Website cookies and similar technologies:

  • SarthiAI’s mobile app does not intentionally use cookies or device identifiers for profiling, advertising, or behavioural tracking.
  • SarthiAI’s website may use cookies and similar technologies for essential functions, preferences, analytics, and (if implemented) other features, as described in the Cookie Policy.

Non-essential cookies and similar technologies on the website will be used subject to consent and user controls, where required by applicable law.

10Privacy, Data Protection, and Children’s Data

10.1DPDP framework: SarthiAI will process personal data in accordance with the Digital Personal Data Protection Act, 2023, its Rules, and other applicable Indian data protection requirements.

10.2Privacy Policy reference:

The Privacy Policy provides detailed information on:

  • what personal data SarthiAI collects (for example, onboarding data, learning profile data, chat transcripts, uploaded content);
  • purposes of processing (for example, providing and improving educational features, personalization, security);
  • data storage location (primary database hosted in Mumbai, India) and possible cross‑border processing by AI infrastructure providers;
  • retention and deletion, including account deletion flows and required log retention;
  • rights of data principals (access, correction, deletion, withdrawal of consent, grievance redressal).

10.3Children’s personal data:

For users under 18, SarthiAI applies additional safeguards described in the Privacy Policy, including:

  • school/Institution‑managed onboarding flows;
  • parent/guardian managed accounts for independent minors;
  • restrictions on behavioural advertising and profiling that may be detrimental to children;
  • verifiable parental/guardian consent where required.

11Intellectual Property

11.1SarthiAI IP:

SarthiAI and its licensors own all rights, title, and interest in and to:

  • the Services and underlying software;
  • design elements, interfaces, and documentation;
  • SarthiAI trademarks, logos, and branding.

11.2No transfer of IP: Nothing in these Terms transfers ownership of any SarthiAI intellectual property to you. You receive only the limited licence described in Section 4.

11.3Feedback: If you provide suggestions, ideas, or feedback, you grant SarthiAI a perpetual, worldwide, royalty‑free licence to use and incorporate such feedback into the Services without obligation or compensation.

12Suspension, Termination, and Account Deletion

12.1Your termination and account deletion:

You may stop using the Services at any time. You may also delete your account via the in‑app settings hub. When you do so:

  • SarthiAI will treat this as a withdrawal of consent and loss of purpose for processing your personal data, subject to legal retention obligations;
  • SarthiAI will initiate erasure of your profile, learning persona parameters, and associated personal data from active systems, except where retention is required by law, as outlined in the Privacy Policy.

12.2SarthiAI suspension/termination for cause:

SarthiAI may suspend or terminate your access (in whole or in part) if:

  • you materially breach these Terms or applicable law;
  • your use poses a security, legal, or reputational risk;
  • SarthiAI is required to do so by law or order of a competent authority.

12.3Effect of termination:

Upon termination:

  • your licence to use the Services ends;
  • SarthiAI may restrict access to your account and User Content;
  • SarthiAI will retain or delete personal data in accordance with the Privacy Policy and applicable law (for example, retaining certain logs for a minimum legal period).

12.4Clarification on Feedback: For the avoidance of doubt, "Feedback" does not include confidential information or User Content submitted solely for obtaining educational assistance through the Services. SarthiAI shall not publicly attribute Feedback to an identifiable User without such User's prior consent.

13Disclaimers

13.1“As‑is” Services: The Services and AI Output are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of accuracy, merchantability, fitness for a particular purpose, or non‑infringement.

13.2No guarantee of results:

SarthiAI does not warrant that:

  • the Services will meet your specific expectations or performance criteria;
  • the Services will be error‑free, uninterrupted, or secure;
  • AI Output will be accurate, complete, or suitable for any particular use.

13.3Third‑party content: SarthiAI is not responsible for the accuracy, availability, or legality of third‑party content or services accessible via the Services.

13.4Different Purchase Channels: Subscription pricing, billing mechanisms and available payment methods may differ depending upon whether the Services are purchased through the SarthiAI website, Apple App Store, Google Play Store or another authorised distribution platform. Any material pricing differences shall be disclosed to the User prior to completing the purchase.

14Limitation of Liability

To the maximum extent permitted by law:

14.1Exclusion of certain damages: SarthiAI will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or business opportunities, even if advised of the possibility of such damages.

14.2Liability cap: SarthiAI’s total aggregate liability to you for all claims arising out of or related to the Services and these Terms will be limited to the greater of:

  • the total amount paid by you to SarthiAI for the Services in the three (3) months preceding the event giving rise to the claim; or
  • INR [Insert Amount].

14.3Non‑excludable liability: Nothing in these Terms excludes or limits liability for death or personal injury caused by gross negligence, or any other liability that cannot be excluded or limited under applicable law.

15Indemnity

15.1You agree to indemnify and hold harmless SarthiAI and its officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of:

  • your breach of these Terms or applicable law;
  • your misuse of the Services or AI Output;
  • any claim that your User Content infringes third‑party rights (including intellectual property, privacy, or personality rights).

15.2Replacement of Third-Party Providers: SarthiAI may replace or modify third-party artificial intelligence models, cloud infrastructure providers or supporting technologies where reasonably necessary to improve security, performance, operational efficiency, legal compliance or commercial sustainability. Such replacement shall not materially reduce the core functionality of an active paid subscription except where reasonably required for legal, technical or security reasons.

16Governing Law and Jurisdiction

16.1Governing law: These Terms and any disputes arising out of or relating to them or the Services shall be governed by the laws of India, without regard to conflict of law principles.

16.2Jurisdiction: Subject to any mandatory provisions of law, the courts at Pune shall have exclusive jurisdiction over all disputes arising from or relating to these Terms and the Services.

16.3Website Cookies and Similar Technologies: SarthiAI's website may use cookies and similar technologies to enable essential website functionality, remember User preferences, analyse website usage and support additional features as described in the Cookie and Tracking Technologies Policy. Where required by applicable law, non-essential cookies shall only be used after obtaining the User's consent. The SarthiAI mobile application does not intentionally use cookies for behavioural advertising or profiling.

16.4Cross-Border Processing: Certain processing activities relating to AI inference, cloud infrastructure, hosting or technical support services may be undertaken by authorised service providers located outside India. Such processing shall be carried out in accordance with applicable law, appropriate contractual safeguards and the Privacy Policy.

16.5Categories of Personal Data: Depending on the Services used, SarthiAI may process account information, contact details, learner profile information, prompts, chat transcripts, uploaded files, learning progress, device and usage information, payment-related information (where applicable) and other personal data described in the Privacy Policy. The categories of personal data processed may vary depending upon the features used, the type of account and any applicable institutional arrangement.

17Changes to These Terms

SarthiAI may update these Terms from time to time. When material changes are made, SarthiAI will:

  • update the “Last updated” date at the top of these Terms; and
  • provide reasonable notice via the app, website, or email.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms.

18Miscellaneous

18.1Entire agreement: These Terms, together with the Privacy Policy, Cookie Policy, and any institutional agreements (where applicable), constitute the entire agreement between you and SarthiAI regarding the Services.

18.2Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

18.3No waiver: A failure by SarthiAI to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

18.4Assignment: You may not assign or transfer your rights or obligations under these Terms without SarthiAI’s prior written consent. SarthiAI may assign or transfer these Terms in connection with a merger, acquisition, or sale of assets or by operation of law.
